*Entrant must be US resident 13 years or older. Entries close 4/2/18 at 11:59pm CST. Submission must be original photography/work. Paul Gross Jewelers will choose 2 finalists based on Submission creativity. In order to be eligible for Grand Prize, finalists MUST verify that they have read and agree to the Official Contest Rules. One Grand Prize Winner will be chosen based on number of votes. No purchase necessary. Void where prohibited.

OFFICIAL CONTEST RULES

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

Sponsor: The 2019 PGJ Promposal Contest (the “Contest”) is organized by Paul Gross Jewelers, located at 241 Oak Street, Wisconsin Rapids, WI 54494. Neither Facebook, Instagram, nor any other social media platform is affiliated with, or a sponsor of this Contest.

 

Eligibility: The Contest is open to legal U.S. residents who are thirteen (13) years of age or older at the date of entry. A MINOR MUST HAVE HIS/HER PARENT’S OR LEGAL GUARDIAN’S PERMISSION TO ENTER. The Contest is subject to all applicable federal, state, municipal, territorial, and local laws and regulations and is void where prohibited by law.

 

Agreement to Rules: By participating, you (and your legal guardian if entrant is a minor) agree to be fully unconditionally bound by these rules, and you (and your legal guardian if entrant is a minor) represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Paul Gross Jewelers as final and binding as it relates to the content. Winning the prize is contingent upon fulfilling all requirements set forth herein. The winner (and his/her legal guardian if potential winner is a minor) may be required to provide a written acknowledgement of acceptance of all terms and conditions of these Official Contest Rules before receiving prize.

Entry Period: The Entry Period begins on March 11, 2019 at 12:00am CEST and ends on April 2, 2019 at 11:59pm CST (the “Entry Period”). Paul Gross Jewelers reserves the right to change, vary, postpone, re-schedule, extend the dates, or cancel the Contest at any time, at Paul Gross Jewelers sole discretion. Entries that are submitted before or after the Entry Period will be disqualified.

 

How to Enter: The 2019 PGJ Promposal Contest must be entered by:

  1. Go to Paul Gross Jewelers Facebook page for the link to the Official Contest Rules located here: https://www.paulgrossjewelers.com/promotions-events/  . Read and agree to the Official Contest Rules. By participating, you (and your legal guardian if entrant is a minor) agree to be fully unconditionally bound by these rules.
  2. Submit an original photo or video depicting your actual promposal OR how you want to get promposed to by posting your promposal to Paul Gross Jewelers Facebook page, or sending your promposal to Paul Gross Jewelers via message thru Messenger.

 

All methods of entry require that you have read and agree to the Official Contest Rules before entry. The entry must fulfill all requirements, as specified, to be eligible to win the prize. Entries that are not complete, unreadable, unintelligible, lewd, offensive or do not adhere to the rules or specifications may be disqualified at the sole discretion of Paul Gross Jewelers. There is no limit to the number of entries per entrant during the entry period. If you use fraudulent methods or otherwise attempt to circumvent the rules, your entry may be removed from eligibility at the sole discretion of Paul Gross Jewelers.

Submission Rules and Guidelines: BY SUBMITTING AN ENTRY, ENTRANT (and his/her legal guardian if entrant is a minor) ACKNOWLEDGE THAT ENTRY AND SUBMISSION MAY APPEAR ON PAUL GROSS JEWELERS WEBSITE OR SOCIAL MEDIA PAGES, AT PAUL GROSS JEWELER’S SOLE DISCRETION. Entrant (and his/her legal guardian if potential winner is a minor) hereby grants Paul Gross Jewelers and its agents an unlimited, worldwide, perpetual, irrevocable license and right to publish, use and publicize Submission in any way, including for any marketing or commercial purposes, without limitation and without any consideration to Entrant. Paul Gross Jewelers reserves the right to alter, change or modify the Submission in any way whatsoever, in its sole discretion.

Paul Gross Jewelers may disqualify any Submission that contains the following:

  • Submission that is promoting alcohol, tobacco, drug use, or firearms/weapons.
  • Submission that contains sexually explicit or suggestive material and/or nudity.
  • Submission that exploits a political agenda or hate speech.
  • Submission containing any use of symbols that is intended to be offensive to others.
  • Submission containing any discrimination against personal characteristics (race, religion, age, sexual orientation, gender identity, disability and physical/mental health).
  • Submission promoting harassment or bullying.
  • Submission containing any shocking or violent images, videos or text.
  • Submission that promotes or depicts any illegal activity, or is itself a violation of the law.
  • Submission containing trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind without permission.
  • Submission containing copyrighted materials owned by others without permission.
  • Submission containing any personal information, including but not limited to full names, phone numbers, email addresses, license plate numbers or street addresses without permission.
  • Submission containing materials embodying the names, likenesses, photographs, or other material identifying any person, living or dead, other than you, without permission from the third-party or a parent or legal guardian if the third-party is a minor.
  • Submission that defames, misrepresents or contains disparaging remarks about Sponsor or its products, or other people, products or companies.
  • Any other images, videos, text or materials deemed inappropriate for any reason by Paul Gross Jewelers at Paul Gross Jewelers sole discretion.

By submitting an entry, Entrant (and his/her legal guardian if entrant is a minor) represents and warrants that Submission is Entrant’s original work, it has not been previously published, does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property rights of any person or entity, that Entrant has obtained permission from a person whose name, likeness or voice is used in the Submission and that the publication of Submission via various media, including website and social media inclusion, will not infringe on the right of any third party. Entrant (and his/her legal guardian if entrant is a minor) further agrees to defend, indemnify and hold harmless Paul Gross Jewelers and it’s agents from any claims to the contrary.

The Selection Process: On or about April 3, 2019, Paul Gross Jewelers will review all entries received within the Entry Period and select 2 finalists based on Submission creativity by representatives of Paul Gross Jewelers at their sole discretion. The 2 finalists will be notified via Facebook/ messenger on April 3, 2019, or as soon as possible after the finalists are selected. Finalists MUST verify that they have read

and agree to the Official Contest Rules before being named a finalist and being entered to win the Grand Prize. Failure to confirm agreement to Official Contest Rules will result in disqualification.

 

The 2 finalists will then go on to the next round where they will eligible for the Grand Prize. On or about April 5, 2019, Paul Gross Jewelers will post the 2 finalists’ Submissions to an Facebook Post on Paul Gross Jewelers Facebook page and ask users to comment on the post to submit their vote based on their favorite promposal. User-generated votes on Submissions are limited to one vote per person. Any votes generated in violation of these rules will be disqualified. Any persons to be found tampering with the voting process may be disqualified from the Contest. All votes shall be interpreted at Paul Gross Jewelers sole discretion and any votes may be disqualified for any reason at Paul Gross Jewelers sole discretion.

 

The Grand Prize Winner will be selected based on the image that receives the most votes, at Paul Gross Jewelers sole interpretation and discretion, between the dates of April 5, 2019 and April 12, 2019 at 11:59pm CST. The One Grand Prize Winner will be notified by April 13, 2019, or as soon as possible after the winner is selected.

 

Paul Gross Jewelers decisions as to the administration and operation of the Contest and the selection of the Finalist Winners or Grand Prize Winner are final and binding in all matters related to the Contest and no correspondence will be entered into by Paul Gross Jewelers in this regard. If a dispute arises over entitlement to a prize, the winner is the person to whom the Instagram account was assigned.

 

No responsibility can be accepted for entries or votes that are not registered or received for any reason. Incomplete entries or votes will be disqualified. Paul Gross Jewelers explicitly reserves the right to refuse or remove a submission of an entrant or a vote, at their sole discretion, in the event that Paul Gross Jewelers determines that an entrant or votes does not comply with all rules and regulations as contained herein.

 

Use Of Personal Information

 

Entrants (and his/her legal guardian if entrant is a minor) consent to the disclosure of their name, likeness, images, social media handles, city and state for the purpose of publishing prize winner’s details and other promotional actions. Paul Gross Jewelers may also use the personal information for promotional marketing and publicity purposes including but not limited to website use, in electronic messages and newsletters, or use on social media outlets, without further notice.

 

All entries and Submissions and any copyright subsisting in the entries or Submissions become and remain the property of Paul Gross Jewelers.

 

Release: Finalists and winner will be required to a written acknowledgement of acceptance of all terms and conditions of these Official Contest Rules before receiving prize and sign release (“Release”) deemed necessary by Paul Gross Jewelers, in its sole discretion, before the prize is awarded. If the winner is a minor, his/her legal guardian will also be required to sign Releases. Releases may include but are not limited to: (i) confirmation of winner’s eligibility for the Contest and compliance with these Contest Rules; (ii) confirmation of winner’s acceptance of the Prize as offered; (iii) any and all tax related forms or documents; (iv) Release for any photographing or filming that may take place during redemption of Prize; (v) Release of Paul Gross Jewelers and it’s partners and their respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (vi) grant Paul Gross Jewelers the

unrestricted right to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the winner’s name, photograph, likeness, voice and biography, and any intellectual property owned by entrant in any and all media now known or hereafter devised, for purposes of this and future promotions without further compensation, except where prohibited.

 

The required executed Releases MUST be returned by the date indicated on the accompanying letter of notification. If the winner fails to return such required Releases, or is unwilling to, unable to, or elects not to, the selected winner may, at Paul Gross Jewelers sole discretion, be disqualified and the Prize forfeited.

 

Liability: By participating in the Contest, all entrants and/or winners (and his/her legal guardian if entrant/winner is a minor) agree to release, indemnify and hold harmless Paul Gross Jewelers, Facebook, Instagram, and any other social media platform used in this Sweepstakes, and its affiliates, subsidiaries, suppliers, distributors, parent companies, and each of their officers, directors, employees, licensees, licensors, shareholders, attorneys, agents, advertising agencies, promotional suppliers, participating vendors or any other company involved, from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize. Entrant (and his/her legal guardian if entrant is a minor) waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

Disputes: Each entrant (and his/her legal guardian if entrant is a minor) agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with a Contest, or any Prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in Delaware; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest, but in no event any legal or attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages (other than for actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of entrant and the Sponsor in connection with a Contest shall be governed by, and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Delaware or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of Delaware.
